These Terms of Service ("Terms") constitute a legal agreement between you or your employer or other person on whose behalf you enter into this agreement ("you" or "Customer") and the Flashmovie.art service and govern the rights and obligations with respect to any Content licensed to you.
Please refer to these Terms whenever you purchase licenses for the materials. Flashmovie reserves the right to change these Terms at any time in its sole discretion. Before such changes become effective, Flashmovie will make reasonable efforts to notify you of any such change. Such notice may be sent to the email address registered in your Flashmovie.art account, posted on this page, on the login page, and/or distributed in other ways. Changes to these Terms will only apply to future purchases (including any automatic renewal). If you license the materials after any such changes, you agree to be bound by the modified Terms.
THIS LICENSE IS A SINGLE-User LICENSE AND ALLOWS A SINGLE INDIVIDUAL TO LICENSE, DOWNLOAD AND USE THE MATERIALS. NO OTHER PERSONS (INCLUDING EMPLOYEES, COLLEAGUES, OR INDEPENDENT CONTRACTORS) SHALL HAVE ACCESS TO YOUR ACCOUNT OR USE THE MATERIALS LICENSED TO YOUR ACCOUNT.
The license for visual materials
Flashmovie hereby grants you a non-exclusive, non-transferable, worldwide, perpetual right to use, modify (except as expressly prohibited herein) and reproduce the Visual Materials, subject to the terms of the applicable license and the limitations described herein.
The STANDARD IMAGE LICENSE grants you the right to use the Images as follows.
As a digital reproduction, including on websites, online advertising, social media, mobile advertising, mobile applications, programs, e-cards, electronic publications (e-books, e-magazines, blogs, etc.), electronic mailing lists, as well as in electronic media.
In printed form on packaging or product labels, on letterhead and business cards, in point-of-sale promotional materials, on CD and DVD covers, or in advertisements and copies of physical media, including magazines, newspapers and books (if provided that the Image is played no more than 500,000 times in total)
In outdoor advertising, including on billboards, outdoor equipment, etc., provided that the intended audience of the campaign is less than 500,000 impressions
In films, videos, television series, advertisements and other multimedia products (hereinafter referred to as “Products”) for distribution by any means now known or will be developed in the future (regardless of audience size), provided that the budget of such video products does not exceed $10,000
For your personal non-commercial use (not for resale, download, distribution or any other form of commercial use)
The IMAGE EXTENDED LICENSE grants, in addition to the rights listed in the paragraphs above, the following rights to use the Images, which apply only to the Enhanced Image License.
In any manner permitted under the Image Standard License without any limitation on the number of reproductions, impressions or budget
On goods and merchandise intended for sale or distribution for promotional purposes (collectively, "Goods"), including textiles, art, magnets, wall stickers, calendars, toys, stationery, postcards, and as part of any other reproduction intended for resale or distribution, provided that such Goods contain significant artistic or functional elements in addition to the Images
In wall stickers (without the need for additional artistic or functional elements) used for decorative purposes in commercial premises owned by you or your client and not intended for sale
As elements of digital templates intended for sale or distribution
If the Standard or Extended Image license does not provide the rights you need, please contact support.
Standard Video License
The standard license is provided by default along with our clip packages, as well as individual and group subscription plans. Standard rights include the following:
- Network usage. Video clips can be used on websites and social media apps, as well as on websites such as YouTube and Vimeo. They can even be used in content that will be digitally uploaded. The size of the audience for such use is limited to 500,000 people.
- Use for live performances. Videos can also be used in live performances, such as musicals, corporate presentations, concerts and musical performances with an audience of up to 500,000 viewers.
- Use on websites. When placing video clips on a web page, there are no restrictions on the size of the audience.
Extended Video License
Our extended license is designed to provide greater reach without restrictions on the size of the audience. These permissions include:
- Unlimited use on the Internet: in multimedia products displayed or distributed over the Internet, in social networks, using so-called "Applications" and unlimited use in digital web templates.
- Unlimited distribution of live performances.
- Unlimited distribution of TV broadcasting, online videos and movies.
- Unlimited video distribution via the Internet (over-the-top (OTT) media service): in OTT video services or in cinemas without restrictions on the size of the audience.
RESTRICTIONS ON THE USE OF VISUAL MATERIALS. YOU HAVE NO RIGHT
Use the Visuals in a manner other than as expressly permitted in your license to the relevant Visuals.
Represent any person depicted in the Visual Materials (the "Model") in a manner that may reasonably be offensive to a person, including, but not limited to, displaying the Model: ”, adult entertainment centers, escort services, dating services, etc.; b) in advertising or promotional materials for tobacco products; c) in a political context, such as in advertisements, promotional materials or materials produced in support of any political party, candidate or elected official, or in connection with any political course or point of view; or in such a way that it can be concluded that the Model d) has a physical or mental illness or e) is involved in immoral or illegal activities.
Use the Visual Materials in a pornographic, defamatory, or defamatory context, or in a manner that may be considered defamatory, obscene, or illegal.
Modify Visuals designated as editorial-only in a way that changes the context of what was filmed.
Visual Materials designated as Editorial Use Only (including, without limitation, Editorial Material) for commercial purposes, including for reference, in any promotional material, in merchandise, and in other non-editorial contexts.
Resell, re-distribute, transfer or make available any Visual Materials except as expressly provided herein. For example, but not limited to, you may not display the Materials in whole or in part as a "gallery" of materials that can be used by third parties to search and select the necessary materials.
Use the Visuals in a manner that infringes third-party trademarks and other intellectual property rights or raises claims of unfair advertising or competition.
Use any Visual Content (in whole or in part) as a trademark, service mark, logo, or other designation of origin, or part thereof.
Directly or indirectly misrepresent that any Visual Content was created by you or any other person who is not the copyright holder of such Visual Content.
VIDEO ONLY RESTRICTIONS
Use footage from the Video in a manner other than contextual marketing, promotion, or advertising of your derivative works that use the Video.
Flashmovie.art has a huge amount of professionally created videos, illustrations and templates that are presented in our store as accurately as possible. Our goal is to help you find exactly what you need. With our video previews which have truncated quality (reduced bitrate and size) and overlaid watermarks, you know that what you see is what you get. Therefore, Flashmovie platform does not offer refunds for Store purchases for any reason.
If you have any concerns regarding misrepresentation of a product, or any questions about the technical aspects of a product, please contact contact support.The refund is made within 30 days after the moment of purchase, under the following circumstances:
- The product "does not match the description" or the product does not work properly.
If the element does not work properly, the author is obliged to promptly fix the problem by updating the element. An item is considered "not as described" if it differs significantly from the item description or preview. If the problem cannot be fixed or it turns out that the item "does not match the description", you are entitled to a refund.
- Products that have not been uploaded
If you have not downloaded the purchased product within 3 months from the date of purchase, you may be eligible for a refund. You will need to provide technical support with your purchase code so that we can confirm your statement that you have not downloaded the item. While we believe 3 months is a reasonable amount of time, depending on where you are, you may have a longer period to claim a refund if you purchased a product for personal use and did not download it.
FlashMovie is not obligated to refund insurance indemnities in any of the situations listed below:
- You don't need it after you downloaded it
- The product did not meet your expectations or you think that the product is of poor quality
- You just changed your mind
- You bought the product by mistake
- You don't have enough experience to use the item
- You claim to be entitled to a refund, but do not provide sufficient information about why you are entitled to a refund.
- You can no longer access the item because it has been deleted (we advise you to download the items as soon as you have purchased them to avoid this situation).
The Flashmovie Store is a marketplace exclusively for digital products files. We do not sell or ship physical products on our platform.
